Jack in the Box and FTX settle the lawsuit via a motion to dismiss
Jack in the Box, a restaurant company that operates and franchises more than 2200 restaurants, has settled the lawsuit with FTX crypto exchange which was filed initially over an alleged mascot-related dispute. As per the lawsuit, FTX US had ripped off the mascot whose trademark rights were with the firm since 1995.

Jack in the Box settled the lawsuit, which has been going on since early November was settled as the duo informed the District Court for the Southern District of California. The two had settled the dispute on Jan 20 and filed a motion to dismiss, but the terms of the settlement remain undisclosed.The lawsuit was initially filed by Jack in the Box against FTX, and the filing showed that FTX had refused to stop using its mascot, claiming that “Jack in the Box has only narrow protection limited to the behatted ping pong‐headed clown who exploded out of a box to sell burgers.”
The character in question was the Moon Man character named Lou Nar, an adult male whose head is that of the moon and is dressed in polo shirts and is used for Major League Baseball events as the mascot of the FTX exchange against Jack, the mascot of the restaurant chain.

A Twitter user commented on the turn of events and noted that Jack in the Box has settled out of court. Initially, the firm had accused FTX exchange of copyright infringement, trademark dilution, trademark infringement, false designation of origin, and unfair competition.The original character from Jack in the Box was developed in 1951. However, in 1995 the current ‘Jack’ or ‘Jack I. Box’ voiced by Dick Sitting, was developed which has appeared in more than 300 TV commercials and radio channels. On the other hand, the exchange FTX was founded in 2019, and the Moon Man was introduced not long ago.
